• Organization and employee profile management

3. User Accounts and Roles

To use SmartShift, you must create an account. There are two types of user accounts:

• Manager Accounts: Have full access to create schedules, manage employees, view availability, and access all features of the platform.
• Employee Accounts: Can view their schedules, update their availability, and access their profile information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

You agree to:

• Provide accurate and complete information when creating an account
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Use the Service only for lawful purposes and in accordance with these Terms
• Not interfere with or disrupt the Service or servers
• Not attempt to gain unauthorized access to any part of the Service

5. Data and Privacy

We collect and process personal information as described in our Privacy Policy. By using SmartShift, you consent to:

• Collection of employee names, emails, phone numbers, and work-related information
• Storage of availability preferences and scheduling data
• Use of AI services to generate shift schedules
• Processing of manager notes and organizational information

All data is stored securely and used solely for the purpose of providing and improving the Service.

6. AI-Generated Schedules

SmartShift uses artificial intelligence to generate shift schedules. While we strive for accuracy and fairness, you acknowledge that:

• AI-generated schedules are suggestions and should be reviewed before approval
• The Service does not guarantee perfect schedules in all situations
• Managers are responsible for reviewing and approving all schedules
• Final scheduling decisions rest with the organization's management

7. Organization Join Codes

Managers receive unique join codes to invite employees to their organization. You agree to:

• Keep join codes confidential and share only with authorized employees
• Be responsible for all accounts created using your organization's join code
• Notify us immediately if you believe your join code has been compromised

8. Intellectual Property

SmartShift and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute any part of the Service
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices
• Use the Service to create a competing product

9. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be available at all times without interruption
• The Service will be error-free or secure
• Results from the Service will be accurate or reliable

We may modify, suspend, or discontinue the Service at any time with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law, SmartShift and its creators shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from scheduling errors or conflicts
• Damages from unauthorized access to your data

Our total liability shall not exceed the amount paid by you (if any) to use the Service in the past 12 months.

11. Employment Law Compliance

SmartShift is a scheduling tool only. You are solely responsible for:

• Compliance with all applicable labor laws and regulations
• Ensuring schedules meet legal requirements (rest periods, maximum hours, etc.)
• Proper payment and recording of employee hours
• Maintaining appropriate employment records

12. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time. Upon termination:

• Your access to the Service will immediately cease
• We may delete your data in accordance with our data retention policies
• Provisions that by their nature should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on the Service or via email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
